GATI PACKERS MOVERS – TERMS AND CONDITIONS OF SERVICE

Please read these Terms and Conditions (“Terms”) carefully before utilizing the services offered by Gati Packers Movers (“Company,” “we,” “us,” or “our”). By confirming a booking or utilizing any of our services, you (“Client,” “Customer,” or “you”) agree to be bound by these Terms.
1. Definitions
1.1. Company: Refers to Gati Packers Movers, the service provider. 1.2. Client/Customer: The individual or entity engaging the Company’s services. 1.3. Consignment/Goods: The items, household effects, or commercial goods to be moved or stored. 1.4. Quotation: The written estimate provided by the Company detailing the cost and scope of services based on the Client’s provided inventory. 1.5. Services: Includes packing, loading, transporting, unloading, unpacking, and storage, as specifically outlined in the final booking confirmation.
2. Scope of Services
2.1. Inclusions: The services provided are strictly limited to those detailed in the final, agreed-upon Quotation and Booking Confirmation. Any requests for additional services (e.g., extra packing material, moving items not listed in the inventory, dismantling/reassembling) must be agreed upon in writing and may incur extra charges. 2.2. Exclusions (Hazardous and Prohibited Items): The Company will not transport items that are illegal, stolen, dangerous, hazardous, perishable, or explosive. This includes, but is not limited to: flammable liquids, compressed gases, firearms, illegal narcotics, live animals, plants, and cash or negotiable instruments. The Client agrees to indemnify the Company against any claims, costs, or damages arising from the inclusion of such items in the Consignment. 2.3. Valuable Items: The Client is solely responsible for moving all valuables, including jewelry, watches, precious metals, deeds, documents, stamps, coins, and electronic data storage devices. These items should not be included in the Consignment.
3. Booking and Payment
3.1. Quotation Validity: Quotations are valid for a period of seven (7) days from the date of issue and are subject to the accuracy of the inventory provided by the Client. 3.2. Booking Confirmation: A booking is only confirmed upon receipt of a signed Booking Confirmation and the payment of a non-refundable booking deposit, which will be specified in the Quotation. 3.3. Payment Terms: The remaining balance of the total moving cost is due and payable in full before the Goods are unloaded at the destination address. We reserve the right to withhold delivery of the Consignment until full payment is received. 3.4. Additional Charges: The Client will be liable for additional charges in the event of: * The Consignment volume or weight exceeding the estimated quantity. * Waiting time caused by the Client’s delay (e.g., key access issues, documentation delays). * Difficult access at either location (e.g., long carries, stairs, non-functional lifts) not disclosed at the time of quoting. * Cancellation or postponement fees (see Section 4).
4. Cancellation and Postponement
4.1. Cancellation by Client: * If canceled more than seven (7) days before the scheduled date, the booking deposit is forfeited, and no further charges apply. * If canceled within seven (7) days of the scheduled date, the Client forfeits the booking deposit and is liable for fifty percent (50%) of the total move cost, reflecting operational costs incurred. 4.2. Postponement by Client: If the move is postponed, the Company reserves the right to retain the booking deposit. A new deposit and Quotation may be required for the rescheduled date, subject to availability.
5. Client Responsibilities
5.1. Accuracy of Information: The Client warrants that the provided inventory list is accurate and complete. 5.2. Preparation: The Client must ensure all items excluded from our packing services (e.g., personal documents, cash, electronics) are removed from the premises prior to the arrival of the Company’s team. 5.3. Access and Permissions: The Client must ensure legal access is available at both the origin and destination addresses, including necessary parking permits, lift reservations, and building permissions. 5.4. Documentation: The Client must be present during loading and unloading or arrange for an authorized representative to be present to sign the inventory and delivery documentation.
6. Liability and Insurance
6.1. Standard Liability: The Company provides limited standard liability coverage against loss or damage to the Goods during transit, subject to proof of negligence on the part of the Company. This liability is capped at a fixed nominal amount per item or per shipment (as detailed in the Quotation) and is not based on the replacement value. 6.2. Valuation and Declared Value: The Client is responsible for declaring the true replacement value of the Consignment. Failure to declare the value means the Consignment will be moved under the Company’s Standard Liability. 6.3. Insurance: The Company strongly recommends the Client purchase independent, comprehensive transit insurance for full replacement coverage. The Company is not an insurance provider and only acts as an agent in arranging insurance if requested in writing by the Client, for which a separate premium will apply. 6.4. Exclusions from Liability: The Company shall not be liable for loss or damage caused by: * War, invasion, acts of foreign enemies, hostilities, terrorism, civil commotion, or military power. * Acts of God, natural disasters, or inclement weather conditions. * Loss or damage to items packed by the Client (PBO – Packed By Owner), unless caused by damage to the external shipping container. * Inherent vice or nature of the Goods (e.g., electronic failure, internal derangement of appliances, deterioration of perishable items). * Loss of or damage to data or software on any electronic equipment. 6.5. Claims: Any claim for loss or damage must be submitted to the Company in writing within three (3) days of delivery. Failure to report loss or damage within this period will result in the forfeiture of the claim.
7. Delivery and Transit
7.1. Delivery Timeframes: All delivery dates and transit times are estimated. The Company will make every reasonable effort to meet these estimates but does not guarantee them. The Company is not liable for any loss or inconvenience resulting from unavoidable delays. 7.2. Redelivery: If the Client is not available or fails to take delivery of the Consignment at the agreed time, the Company reserves the right to charge for redelivery and any subsequent storage costs incurred.
8. Governing Law
8.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g., India], and any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [Insert City, e.g., New Delhi].
